1. Acceptance

By creating an account or using the platform ("SociMart", "we", "our"), you agree to these Terms of Service, our Privacy Policy, and applicable policies referenced here. If you do not agree, do not use the platform.

2. Nature of the platform — marketplace facilitator

SociMart is a marketplace facilitator under the Information Technology Act, 2000 and the Consumer Protection Act, 2019. We do not own, sell, or resell the products listed. All contracts of sale are directly between the Seller and the Buyer. SociMart provides technology, discovery, communication, payment facilitation, and optional inspection — but is not a party to the sale.

3. User accounts

You must be 16 years or older to create an account.
You are responsible for maintaining the confidentiality of your login credentials.
One person may hold one buyer account and, separately, one seller account.
Providing false GST/PAN/identity information is grounds for immediate suspension.

4. Seller obligations

Sellers agree to: (a) list only products they are legally authorized to sell in India; (b) accurately describe product condition, materials, and country of origin; (c) hold valid GST registration and share GSTIN on request; (d) fulfil confirmed orders within the delivery timeline they publish; (e) honour the Returns Policy and Refund Policy.

5. Prohibited use

You will not: (a) list counterfeit, restricted, or illegal goods; (b) attempt to defraud any party; (c) reverse-engineer or scrape the platform; (d) impersonate any person or entity; (e) transmit malware or spam.

6. Intellectual property

SociMart owns all platform code, branding, logos, and product taxonomy. Sellers retain all rights to their own product photos, videos, and copy, and grant SociMart a non-exclusive, worldwide, royalty-free licence to display, distribute, and cache that content for the purpose of running the marketplace and its search, sitemap, feed, and social embed features.

7. Payments

Payments are processed by RBI-regulated payment gateways (Razorpay and Cashfree). SociMart never stores full card numbers or CVV. Refer to the Refund Policy for refund windows.

8. Optional inspection

Buyers may request an independent, on-site inspection of a listed product for a flat fee paid by the buyer. Inspection is never mandatory. Inspection reports are advisory and do not create any warranty from SociMart. The buyer-seller contract of sale is unaffected by inspection outcome unless the parties explicitly agree otherwise.

9. Content moderation

SociMart may, at its sole discretion, remove listings, content posts, comments, or accounts that violate these terms or applicable Indian law, with reasonable notice where practical.

10. Limitation of liability

To the maximum extent permitted by law, SociMart's total liability in any 12-month period is limited to the platform fees actually paid by the affected user in that period. SociMart is not liable for indirect, incidental, consequential, or punitive damages arising from a seller-buyer transaction.

11. Indemnification

You will indemnify SociMart from claims arising out of your breach of these terms, your content, or your sale/purchase.

12. Dispute resolution — governing law and jurisdiction

These terms are governed by the laws of India. Any dispute arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts at Mumbai, India, except that consumers retain any additional protection available under the Consumer Protection Act, 2019 including the right to approach District/State/National Consumer Commissions.

13. Changes to these terms

We may revise these terms from time to time. Material changes will be announced via in-app notification and email at least seven (7) days before taking effect.
